Kyte Energy Warranty Policy

Version 1.0 · Effective for vehicles sold on or after [date of publication] · Issued by Kyte Energy Pvt. Ltd., Nashik, Maharashtra

1. About this policy

1.1 This policy is the complete and only warranty Kyte Energy Pvt. Ltd. ("Kyte") gives on Kyte electric two-wheelers sold in India. It applies to every Kyte model, including Magnum, Magnum Pro, Kyte X2, Stella S and Stella S Pro, in every battery variant.

1.2 It replaces every earlier warranty statement, including those in earlier owner's manuals, brochures, advertisements, price lists and dealer material. Where any of those say something different, this policy applies.

1.3 "Customer" means the first retail buyer named on the Kyte dealer's tax invoice. "Authorised dealer" means a dealer appointed in writing by Kyte and listed at www.kyteenergy.com. "Date of sale" means the date on the authorised dealer's tax invoice to the customer.

1.4 The version of this policy in force on the date of sale applies to that vehicle for its whole warranty period. The current version is always at ticket.kyteenergy.com/warranty-policy.

2. What is covered

2.1 Kyte warrants the following four components against defects in materials and workmanship under normal use:

ComponentWarranty period
Motor12 months from the date of sale
Controller12 months from the date of sale
Battery pack12 months from the date of sale (24 months for the variants in 2.1A)
Charger12 months from the date of sale

2.1A Battery exception. The battery variants marked below carry a battery warranty of 24 months from the date of sale instead of 12. All other battery variants carry 12 months. The battery period for each vehicle is printed on its warranty card, which decides in case of doubt.

ModelBattery variants with 24-month battery warranty
Magnum60V 30Ah lithium
Magnum Pro60V 40Ah and 60V 48Ah
Kyte X260V 30Ah lithium, 60V 40Ah lithium
Stella S60V 30Ah lithium (variant 4)
Stella S Pro60V 30Ah lithium (variant 4)

The 24-month period applies only to the battery pack. The motor, controller and charger stay at 12 months.

2.2 No other part, assembly or accessory is covered (see section 4).

2.3 If a covered component is found defective under this policy, Kyte will, at its sole choice, repair it, replace the faulty sub-part (for example a BMS, cell module, PCB or winding), or replace the component with a new or reconditioned unit of equal or better specification.

2.4 A repaired or replacement component is covered only for the remainder of the original warranty period. Repair or replacement never extends or restarts the warranty.

2.5 Every part removed under warranty becomes Kyte's property. No scrap value, credit or refund is given for it.

3. When a battery counts as defective

3.1 A battery pack is defective only if, during the warranty period: (a) its Battery Management System (BMS) has failed; or (b) its usable capacity has fallen below 60% of its rated capacity.

3.2 Capacity is measured only by Kyte or its authorised dealer, at about 25°C, by fully charging the pack with the Kyte charger supplied for that model and discharging it at the rated test current until the BMS cuts off. The result is recorded on the inspection report.

3.3 Lower range than the brochure figure is not a defect. Brochure ranges are measured under the Indian Driving Cycle (IDC) in test conditions. Real range depends on load, speed, road, tyre pressure, temperature, riding style and battery age.

3.4 Every battery loses capacity with use. A reduction of up to 40% within the warranty period is normal ageing and is not a defect.

4. What is not covered

4.1 Parts not covered. Every part other than the four in section 2.1, including: DC-DC converter, throttle, display and instrument cluster, wiring harness, connectors, fuses and MCB, switches, locks, keys, remote and NFC tags, lights and bulbs, horn, USB port, tyres and tubes, wheels and rims, bearings, brake shoes, pads, discs, drums and cables, suspension, frame paint, body panels and all plastic parts, seat and seat cover, mirrors, stands, footboard, stickers and accessories.

4.2 Wear and maintenance. Normal wear and tear; routine service, cleaning, adjustment and lubrication; consumables; and normal noise, vibration, fading, discolouration, rust or surface corrosion.

4.3 Damage from outside causes. Accident, collision, fall, theft or attempted theft, vandalism, fire, lightning, flood, water logging, earthquake, riots or any other event outside Kyte's control.

4.4 Losses. Loss of use of the vehicle, travel or hire costs, loss of income or business, inconvenience, or any other indirect or consequential loss (see section 9).

5. Conditions for a valid claim

A claim is accepted only if all of these are true:

5.1 Registered. The authorised dealer registered the vehicle with Kyte within 15 days of the date of sale, with the customer's details, chassis number and the serial numbers of the motor, controller, battery and charger.

5.2 Proof of purchase. The customer shows the original tax invoice from an authorised dealer and the Kyte warranty card.

5.3 Within time. The defect first appeared within the warranty period, and the vehicle or component is presented to an authorised dealer within 15 days of the defect appearing and no later than the last day of the warranty period.

5.4 Serials intact. The chassis number and every component serial number and seal are present, readable, unaltered and match Kyte's registration record.

5.5 Serviced on time. Every scheduled service in the owner's manual was done on time at an authorised dealer and recorded in the service record or the Kyte service system.

5.6 Used as intended. The vehicle was used, charged, stored and maintained as the owner's manual says, and none of the conditions in section 6 apply.

5.7 Original owner. The claim is made by the customer. The warranty does not pass to a later owner unless Kyte agrees in writing.

6. When the warranty is void

The warranty on the affected component ends, and any claim on it is refused, if Kyte's inspection finds any of the following.

6.1 For every covered component

  • Opened, dismantled, repaired or modified by anyone other than Kyte or an authorised dealer, including broken or disturbed seals, screws or warranty stickers.
  • Serial number, label or sticker removed, defaced, altered or not matching the registration.
  • Water, liquid, mud or moisture inside the component, including from high-pressure washing or riding or parking in water above the level of the motor or battery.
  • Physical damage: cracks, dents, broken casing, enclosure or connectors, cut or twisted wires, burnt connectors or tracks.
  • Overloading: carrying more than the rated load or riders, or sustained climbing of steep slopes beyond the vehicle's rating.
  • Fitting of non-Kyte parts or extra electrical accessories, or any change to wiring, voltage, speed or controller settings.
  • Use for racing, stunts, commercial hire or delivery fleets (unless sold for that purpose under a written Kyte agreement), or any non-vehicle use.
  • Damage from accident, fire, flood or any cause listed in section 4.3.

6.2 Battery pack

  • Charged with any charger other than the Kyte charger supplied for that model, or with fast-charging or unapproved profiles.
  • Casing opened or forced; container or cover broken, swollen or bulged from overcharging, heat or impact.
  • Deep discharge from being left uncharged or unused for more than 30 days, or stored outside the temperature limits in the owner's manual.
  • Short circuit from misuse, wrong testing or loose or wrong connections.
  • Moved to another vehicle, system or use.

6.3 Motor

  • Screws open or missing, side cover damaged, or unauthorised welding on the motor or its mounts.
  • Water inside, or rust on magnets or stator.
  • Axle bent or broken, rim damaged, or magnets broken by impact or overloading.
  • Coil or connectors burnt from overloading or sustained steep climbing.

6.4 Controller and charger

  • Screws open or missing, or enclosure or connector damaged.
  • Burnt tracks or MOSFET failure caused by overloading or a short circuit.
  • Water or liquid inside.
  • Charger dropped, used outdoors or in the rain, covered while charging, its cable cut or joined, or plugged into an unstable or unearthed supply.

7. How a claim is handled

7.1 The customer takes the vehicle or component to an authorised dealer, who opens a service ticket in the Kyte service system with photos of the vehicle, the serial labels and the fault.

7.2 Kyte's service centre inspects and tests the component. Every inspection is recorded with photos, readings and the names of the technician and the Service Head who checked it.

7.3 Kyte decides, based on that inspection, whether the defect is covered and which remedy under section 2.3 applies. The customer receives a written technical report giving the result and the reasons, and may ask for copies of the photos and readings.

7.4 If the claim is accepted, Kyte carries out the remedy and returns the component through the dealer.

7.5 If the claim is refused, the report states the reason by reference to this policy. The customer may then (a) approve a paid repair at Kyte's quoted price, or (b) collect the component unrepaired after paying the inspection and return-freight charges in section 8.3.

7.6 A component that is not collected, or for which no instruction is given, within 60 days of Kyte's written notice may be disposed of by Kyte after a second written notice, and no compensation is payable.

7.7 The customer can follow the claim at any time on the tracking page using the ticket number and serial number.

7.8 Kyte may ask for the whole vehicle to be presented for inspection, and may download fault and usage data stored in the controller, BMS or display, to establish the cause of a fault.

7.9 False claims. If a claim is supported by false information, altered documents or serial numbers, or a swapped component, Kyte will refuse it, may cancel the remaining warranty on that vehicle, and may recover its inspection and freight costs from the person who made the claim.

8. Costs

8.1 Accepted claims: parts and labour for the remedy are free. Kyte pays freight between the authorised dealer and Kyte's service centre.

8.2 The customer pays for taking the vehicle to and from the authorised dealer, and for any consumables, routine service items or non-covered parts replaced at the same visit.

8.3 Refused claims: the customer pays a fixed inspection charge of ₹[amount] per component and the freight to return it, as shown on the dealer's price list at the time.

9. Remedies and limits

9.1 Repair or replacement under section 2.3 is the customer's only remedy under this warranty. Kyte does not refund the price of, or replace, the whole vehicle under this warranty.

9.2 Kyte is not liable for loss of use, hire or travel costs, loss of income or business, inconvenience, or any indirect, incidental or consequential loss.

9.3 Kyte's total liability for any claim under this warranty will not exceed the price of the defective component on Kyte's spare-parts price list on the date of the claim.

9.4 Nothing in this policy limits liability for death or personal injury caused by Kyte's negligence, or any right the customer has under the Consumer Protection Act, 2019 or other law that cannot be excluded. This warranty is given in addition to those rights.

10. Dealers and promises

10.1 Authorised dealers are independent businesses, not Kyte's agents. No dealer, salesperson or employee may change, extend or add to this warranty, by word, message or in writing. Only a written document signed by an authorised Kyte director can do that.

10.2 Any promise beyond this policy made by a dealer is the dealer's own responsibility.

11. Records and evidence

11.1 By registering the vehicle, the customer agrees that Kyte may record and keep their name, contact details, address, invoice and vehicle data, and photos, test readings and service history of the vehicle, to provide warranty and service and to verify claims.

11.2 Kyte's service records, inspection reports, photos and test readings made at the time are the record of the vehicle's condition for warranty purposes.

11.3 Kyte will not sell this data. It is handled under Kyte's privacy notice and the Digital Personal Data Protection Act, 2023.

12. Changes to this policy

12.1 Kyte may change this policy at any time for vehicles sold after the change. A change never reduces the warranty on a vehicle already sold (see section 1.4).

12.2 Kyte may change specifications, colours and features of its products without notice. This does not affect the warranty on vehicles already sold.

13. Law and disputes

13.1 This policy is governed by the laws of India.

13.2 A customer with a complaint should first contact the authorised dealer, then Kyte at supportservice@kyteenergy.com with the ticket number. Kyte will reply in writing.

13.3 Subject to the customer's right to approach a consumer commission under the Consumer Protection Act, 2019, the courts at Nashik, Maharashtra have exclusive jurisdiction.

13.4 If any part of this policy is found invalid or unenforceable, the rest remains in full force.

14. Customer acknowledgement
